Born in Canada, not wanted in Canada

Jul 6 2013, 4:36am CDT | by

Toronto, July 6 (IANS) A Canada-born man of Indian descent, who has served time in jail, is now fighting to stay on in the country of his birth.

Toronto, July 6 — A Canada-born man of Indian descent, who has served time in jail, is now fighting to stay on in the country of his birth.

The case of Deepan Budlakoti, 23, has caught the attention of the Canadian media, a section of which has described his predicament as Kafkaesque.

Budlakoti was born Oct 19, 1989 to Indian parents who had come to work as household support staff at the Indian High Commission in Ottawa.

He holds a birth certificate issued by the Canadian province of Ontario but his passport has been revoked by Canadian authorities who want to deport him to India, a country he has never been to.

Citizenship and Immigration Canada says his passport application "claimed incorrectly that he was a citizen" and that "he was convicted, and served significant jail time, for trafficking both weapons and drugs", CTV News reported.

The parents later worked for an Ottawa university professor, became landed immigrants and then went on to become Canadian citizens.

Their son applied for as a minor and as a teenager and got a Canadian passport and they never thought of applying for a Canadian citizenship for him.

Now that Budlakoti has served three years in prison for crimes he committed and his passport has been revoked, the Canadian Border Service Agency (CBSA) is trying to convince India that it should take him back.

India has rejected the demand.

Kapil Sharma, consular officer at the Indian mission, has told the CBSA that Budlakoti was not an Indian citizen.

Budlakoti admits he did "stupid things" but says he he is older now and wants to move on with life in Canada.

But he faces a big problem in the sense that he does not have a work permit given his crime record. At the same time, India does not seem to be a way out for him.

"I don't know no one there (in India), I have no family there. I have no nothing there," he was quoted as saying.

The Globe and Mail, describing Budlakoti's life as a bizarre, almost-Kafkaesque existence, said "he lives in fear that, any day, government agents could knock on his parents' door in Ottawa, haul him away and put him on a one-way flight to India".

Nathalie Des Rosiers, general counsel of the Canadian Civil Liberties Association, described Budlakoti's plight as a disgrance and "tantamount to cruel and unusual punishment", something that all Canadians should be worried of as their status in the country could come up for "vindictive re-assessment" any time.

"It is like something out of Kafka," The Globe and Mail quoted Budlakoti's lawyer Peter Stieda as saying in reference to the surreal protagonists created by Prague-born writer Franz Kafka.

On Tuesday, illegal immigrant DREAMers demanded hearings for every illegal immigrant juvenile who has been apprehended. "We have a moral obligation to protect defenseless refugee children from harm and to ensure that each child receives a full and fa ...

But, every two years, the Hawaiian Islands become a serious training ground for military forces from around the world -- and their trip to the beach looks very different. Salmon: On Border Crisis, Let's Not Take A Knee

Jul 25 2014 7:58am CDT | Source: Big Government

As a Member of Congress from a state on our southern border, I see firsthand the realities of illegal immigration. In fact, much of the recent public outcry originated from busloads of illegal immigrants dumped in Arizona a few short months ago. The strain placed on state and local governments overwhelms security, education, and medical services, making them harder to come by for citizens and immigrants alike. We’ve all read the stories of blown budgets and rising crime, but Members of Congress ...

Jul 22 2014 3:50pm CDT | Source: Politics - The Huffington Post

The new mother sits, her days-old infant at her breast. He suckles silently, tiny eyes closed. Thomas Wilcox Volz: unique, beautiful, inspiring and wondrous. "He's six pounds fifteen ounces", his father says proudly. One week old, he'd gained back all but one ounce of his birth weight. I had forgotten the lessons of a newborn, ours being 25 years ago: At birth, the baby loses weight until able to digest its mother ...

Stop Inversions with Tax Cuts

Jul 22 2014 1:23pm CDT | Source: Downsizing Government

Chris EdwardsThe corporate inversion trend tells us that global tax competition is intense and that U.S. tax reform is long overdue. Our combined federal-state corporate tax rate of 40 percent is far higher than the rates of our trading partners. Inversions are a bid by companies to create self-help tax reform while Congress sits on its hands.U.S. companies compete in foreign markets against firms based in countries that have lower tax rates and that exempt foreign business income from tax. Thus ...
