US Sikh group to serve Badal summons in India

Jul 15 2013, 10:58pm CDT | by

New York, July 16 (IANS) A US Sikh group has engaged a Washington firm to serve two US federal court summons on Punjab Chief Minister Parkash Singh Badal on charges of human rights violations in India.

New York, July 16 — A US Sikh group has engaged a Washington firm to serve two US federal court summons on Punjab Chief Minister Parkash Singh Badal on charges of human rights violations in India.

The New York based "Sikhs for Justice" (SFJ) had earlier offered $20,000 to anyone who could successfully serve the summons to Badal, who was expected to visit Milwaukee, Wisconsin, for a wedding on July 5.

SFJ said Monday it has retained the services of "Process Forwarding International" (PFI), a Washington based company to serve the summons on Badal in India.

A Milwaukee court had thrown out a lawsuit against Badal in May over conflicting reports about whether the person served with court papers was actually Badal. The federal court for the Eastern District of Wisconsin has given SFJ until Oct 24 to serve the summons on Badal in a human rights violation lawsuit.

SFJ and Shiromani Akali Dal (Amritsar), headed by Simranjit Singh Mann, have filed the human rights case against Badal and his son Sukhbir Singh Badal, the state's deputy chief minister, accusing them of overseeing and condoning the detention and torture of political prisoners.

The complaint alleges that the Badals throughout their tenure "have actively shielded, protected and promoted the police who were or have been involved in gross human rights violations, extra judicial killings and torture".

SFJ legal advisor Gurpatwant Singh Pannun said, "we will use Hague Service Convention to serve outstanding federal summons on Badal in India."

The Hague Service is a treaty signed by both India and United States which allows service of judicial papers between the signatory countries without diplomatic involvement, he said.

Under Article 15 of the Hague Service Convention, service is considered complete once copy of summons and complaint is delivered to the central authority of India which is responsible to receive judicial documents from foreign courts, Pannun said.

The lawsuit against Badal has been filed under Alien Tort Claims Act (ATCA) and The Torture Victim Protection Act (TVPA) alleging that the defendants authorised, commanded, or directed the unlawful acts of the security forces operating under their command and authority.

Indian Patients Lose under Indian Patent Regime

Sep 12 2014 7:00am CDT | Source: National Center for Policy Analysis

According to the U.S. Chamber of Commerce's Global Intellectual Property Center, India ranks last in its list of 25 countries when it comes to intellectual property laws. NCPA Senior Fellow John Graham explains how the country's patent laws hurt Indian patients: because few drugs receive strong patent protection, drug-makers are loath to sell their medicines in India. Because of India's weak intellectual property regime, new drugs are immediately copied when they enter ...

(Clinical) Fear and Loathing in America

Sep 9 2014 11:45am CDT | Source: Politics - The Huffington Post

The world is more frightening and complex than ever. We are in more danger. We are less aware. We are nearing a war to end all wars. We are closer to death--metaphorical or literal. So say the pundits, at least. Indeed, with the reach of the media--and particularly news--it's easy to believe we're in constant danger--physical and cultural. But it's also somehow too convenient to think that the world is so complex and so scary (naturally, we fea ...

Change Culture, Not Cabs: Woman-Only Taxis and Commodifying Female Fear

Sep 8 2014 1:59pm CDT | Source: Politics - The Huffington Post

SheTaxis (known as SheRides in New York City) is a newly-launched app that will help women-only passengers find women-only taxi drivers. If you are a woman, the creators argue, it makes sense to use this car service, because taking taxis and Ubers driven by men can be dangerous. There is a whole lot of money to be made helping women adapt to this problem. This approach to "keeping women safe ...
